Terms of Use

1. Eligibility and Accounts

Age Requirement: You must be at least 13 years of age to use Kai. If you are under 18, you represent that you have your parent or guardian's permission to use the App.

Account Creation: To use the App, you must register for an account. We offer social login options via Google and Apple. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

No Guest Access: Full access to Kai's features requires a registered account.

2. Subscriptions and Payments

Billing: All subscriptions and payments are processed through the Apple App Store. You agree to comply with all relevant Apple terms and conditions.

Subscription Tiers:

• Annual Subscription: Includes a 3-day free trial. You will be charged the annual fee automatically at the end of the trial unless you cancel via your Apple ID settings at least 24 hours before the trial expires.
• Monthly Subscription: No free trial is provided for monthly plans.

Refunds: All refund requests must be directed to Apple. We do not process refunds directly.

3. AI Disclaimer and Content

AI Accuracy: Kai is an AI-powered language companion. You acknowledge that AI can "hallucinate" or provide inaccurate translations, grammatical errors, or factual misinformation. Kai is a learning aid, not a substitute for professional instruction or official documentation.

Screen Sensing & Voice Data: By using Kai, you grant us permission to:

• Sensing: View and process the text and visuals on your screen while the App is active to provide contextual language learning.
• Voice: Record and transcribe your voice input to analyze speech and provide feedback.

Usage: You agree that we may use this data to improve our AI models and provide your personalized learning experience.

4. Prohibited Conduct

You agree not to engage in any of the following:

• AI Manipulation: Attempting to "jailbreak," bypass safety filters, or reverse-engineer Kai's AI models or personality guardrails.
• Automated Access: Using bots, scrapers, or automated scripts to interact with Kai.
• Academic Dishonesty: Using Kai to cheat on proctored exams or graded assignments where prohibited by your institution.
• Privacy Violations: Using the screen-sensing feature to capture or store the private or sensitive information of third parties without their consent.

5. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms, including but not limited to:

• Violation of the Prohibited Conduct section.
• Failure to pay subscription fees via the App Store.
• Using the service in a way that creates a safety risk for other users or the platform.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAI'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL BE LIMITED TO THE TOTAL AMOUNT PAID BY YOU TO KAI FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding shall be brought exclusively in the courts located in New York, NY.
